MICHAEL P. HERZOFF is the head of our Commercial Litigation and Dispute Resolution practice. Michael has litigated at all levels of state and federal courts, and has represented clients in various types of lawsuits and arbitration proceedings, including shareholder and partnership disputes, construction disputes, employment and civil rights defense, fraudulent conveyance recoveries, real estate disputes, and breach of contract litigation. Michael has also represented our clients in bankruptcy adversary proceedings. Prior to joining Jacob & Weingarten in 1999, Michael gained invaluable experience litigating claims against insurance companies.

Michael has extensive trial experience, and has achieved excellent results in numerous court trials and arbitration proceedings. In the past year alone, he tried three large arbitration cases in which our clients were forced to defend million dollar plus alleged claims against them, and in all these actions, Michael obtained no causes of action. In another recent matter, he not only obtained an award on behalf of our client, but also obtained a decision awarding the repayment of virtually all the attorneys' fees our firm incurred in the matter. Prior to joining Jacob & Weingarten, Michael and another attorney obtained a jury verdict in excess of $7,000,000 in a malpractice case.

Michael has also successfully defended numerous construction lien cases filed against property owners, and has prosecuted construction liens and bond claims filed by contractors. Michael has also successfully collected upon six and seven figure judgments on behalf of creditors and bankruptcy trustees against entities and individual debtors engaging in the fraudulent transfer of assets to avoid collection.

Michael received his law degree in 1988 from DePaul University College of Law in Chicago Illinois where he graduated with honors. He received his B.B.A, with honors, in 1984 from the Michigan State University College of Business.

Michael has been given the highest rating of "AV" by his peers in connection with a survey done by Martindale - Hubbell Law Directory. AV means very high to preeminent legal ability - very high general recommendation.
